APPLICANT REQUESTS THAT:
His records be corrected to reflect military service in Germany.
APPLICANT CONTENDS THAT:
His DD Form 214, Armed Forces of the United States Report of
Transfer or Discharge, does not reflect his temporary duty (TDY)
status to Hahn Air Base, Germany. His military records do not
reflect this deployment, nor his participation.

STATEMENT OF FACTS:
The applicant initially entered the Regular Air Force on
22 Apr 58.
On 21 Apr 62, the applicant was released from active duty upon
completion of required active duty time and was credited with
four years of active service, which included 1 year, 10 months,
and 11 days of foreign service.
The remaining relevant facts pertaining to this application are
contained in the memorandum prepared by the Air Force office of
primary responsibility (OPR), which is attached at Exhibit C.
AIR FORCE EVALUATION:
AFPC/DPAPP recommends denial indicating there is no evidence of
an error or an injustice. The applicant failed to provide, nor
did the personnel records contain, any documents that
substantiate foreign service time in Germany.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant submitted a letter asking that the board review
the history of the deployment of the 355th Tactical Air Command
(TAC) Fighter Wing during the period of Sep 61 through Nov 61.
He was not on orders because he departed from Myrtle Beach on
alert basis. A complete copy of the applicants response is at
Exhibit E.
FINDINGS AND CONCLUSIONS OF THE BOARD:
After careful consideration of applicants request and the
available evidence of record, we find the application untimely.
Applicant did not file within three years after the alleged
error or injustice was discovered as required by Title 10,
United States Code, Section 1552 and Air Force Instruction
36-2603. Applicant has not shown a plausible reason for the
delay in filing, and we are not persuaded that the record raises
issues of error or injustice which require resolution on the
merits. Thus, we cannot conclude it would be in the interest of
justice to excuse the applicants failure to file in a timely
manner.
THE BOARD DETERMINES THAT:
The application was not timely filed and it would not be in the
interest of justice to waive the untimeliness. It is the
decision of the Board, therefore, to reject the application as
untimely.
